December 8, 2009 Board Meeting Agenda Item #11 Title APPROVAL TO AUTHORIZE COUNSEL TO TAKE ALL APPROPRIATE LEGAL ACTIONS IN THE ARBITRATION CASE OF DUNCAN V. SCHOOL BOARD Description Employee Thomas S. Duncan grieved his initial salary placement through the step of arbitration.  The arbitrator found that the employee was a member of the instructional collective bargaining agreement but then disregarded the language of the bargaining agreement when determining the employee's placement on the salary schedule.  This violates the terms of the bargaining agreement and exceeded the arbitrator's power under the agreement and the stipulation of the parties. Recommendation That the School Board authorize counsel to take all appropriate legal actions, including filing suit or other application with the Circuit Court, in order to seek vacation of the arbitrator's ruling in the arbitration case of Duncan v.
